1.4 For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to the services of the Website by providing relevant data required for registration as a user. "Services" shall mean the performance of religious ceremonies, rituals or related services rendered through the Website. "Service Providers" means, including but not limited to, any person, institution, firm, trust, company association or any entity that provides Services on the Website or facilitates the provisions of such Services. The term "Company", "Website", "Puja Services", "We", "Us", "Our" shall mean Puja Services India Private Limited and its affiliates.
1.5 The headings and sub-headings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of the Terms of Use or the right to use the Website by You contained herein or any other section or pages of the Website or any linked sites in any manner whatsoever.
1.6 The Terms of Use herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine and feminine.
1.7 The Company offers this Website, including all information, tools and services available from this Website to You, the User, subject to your acceptance of all terms, conditions, policies and notices stated here.
1.8 The Company intends to be an online service facilitator/aggregator of religious ceremonies and rituals and the Users can choose to have such ceremonies or rituals performed at the place elected by them or on their behalf. The Website shall connect Users seeking such services with the relevant Service Providers such as pujaris, priests in temples etc., who shall perform the ceremony or conduct the ritual at the place elected by the User. The Company also provides the User a choice of virtually paying for ceremonies or rituals to be conducted on their behalf in various Hindu temples in India. The Website also provides customized information about horoscope, temple events, daily muhurats etc.
1.9 When You use any of the Services provided on the Website, You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such Service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as an integral part of this Terms of Use. We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior notice to You. You shall ensure that you will review these Terms of Use periodically for any updates/changes that we may do. Your continued use of the Website following the posting of changes will mean that You have accepted and expressly agreed to the revisions. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited license to enter and use the Website. 3.1 To register yourself with the Website, you shall be required to create an account by registering through your email account or by filling in the details prescribed in the Website registration form. Every User must keep the account and registration details current and correct for communications related to your purchases from the Website.
3.2 The Website does not charge any registration/membership or browsing fee. However, the Website reserves the absolute right to alter the fee policy at any time.
3.3 If You use the Website, You shall be responsible for maintaining the confidentiality of your User Name and Password and You shall be responsible for all activities that occur under your User ID and Password.
3.4 Users of the Website may be required to provide certain personal information such as date of birthday, address etc., and the User expressly permit the Company from accessing and/or collecting and retaining such personal information of the Users. 4.2 The Company grants you no sub-license, whether limited or not, to access and make personal use of the Website, and to download (other than page caching) or modify it or any portion of it, except with express written consent of the Company.
4.3 Any unauthorized use or modification of the Website or materials published on the Website for any other purpose, other than as expressly permitted by the Company, shall constitute violation of Company's copyright and other proprietary rights and shall render you liable for civil, criminal or other relevant legal proceedings.
5.1 The Services can be purchased through the Website through various methods of payments offered. All prices are in Indian rupees.
5.2 You shall be responsible for payment of all fees/costs/charges associated with the purchase of products from us and you agree to bear any and all applicable taxes including but not limited to GST, duties and cesses etc., wherever applicable.
5.3 The payments made by the User through valid debit/credit card/internet banking over a secure payment network shall be collected via HDFC's appointed payment gateway. Any payment gateway charges levied by them shall be applicable.
5.4 The Company has engaged the services of HDFC, a payment gateway which has SSL protection. Though the Company has undertaken utmost care to provide secure payment system, the Users must acknowledge that all online payment systems are susceptible to hacking, virus attacks, malfunction.
5.5 Any information entered by the User when transacting on the Website is encrypted to protect the User against unintentional disclosure to third parties. The Users credit and debit card information is supplied by the User directly to the relevant payment gateway which is authorized to handle the information provided and is compliant with the regulations under Indian Law.
5.6 The credit/debit card information provided by User will not be utilized or shared with any third party unless required in relation to fraud verifications or by law, regulation or court order.
5.7 The Company shall not be liable for any loss or damage occurred to User arising directly or indirectly due to the decline of authorization for any transaction malfunction, errors and/or unscrupulous activities.
6.1 We may communicate with you by e-mail, SMS, phone call or by posting notices on the website or by any other mode of communication.
6.2 For contractual purposes, you hereby expressly consent to receive communications (including transactional, promotional and/or commercial messages), from us with respect to Your use of the Website and/or Your order placed on the Website.
7.1 Any order placed through the Website or the App for availing any of the Services offered on the Portal can be cancelled prior to at least 2 days before the scheduled date of performance of Service.
7.2 The Website will refund the entire fee if paid online. The fee will be refunded to your credit card / debit card / online bank account that were used for the particular transaction. All refunds and the timeframe for such refund shall be subject to the terms and conditions prescribed by the payment gateway.
8.1 The Company, make no representations or warranty of any kind, express or implied, including but not limited to, that (i) the services of the Website will meet your requirements or set standard of expectations; (ii) the services of the Website will be uninterrupted, timely, secure, accurate or error-free; (iii) the results that may be obtained or expect to be obtained from the use of such Services will be accurate or reliable; (iv) the quality of any products, Services, information or other material purchased or obtained by you through the Service Provider or through the depiction(s) made by the Service(s) advertiser(s) or partners will meet your expectations or requirements.
8.2 To the complete extent permissible by the applicable law, Company disclaims all warranties, express or implied, including, but not limited to the warranties of quality, Services on fitness for a particular purpose.
9.1 You agree to indemnify and hold harmless Puja Services India Private Limited its subsidiaries, affiliates and their respective officers, directors, agents and employees, from any claim or demand, or actions including reasonable attorney's fees, made by any third party against the Company or penalty imposed on the Company due to or arising out of your breach of these Terms of Use or any document incorporated by reference, or your violation of any law, rules, regulations or the rights of a third party.
10.1 These Terms of Use are effective unless and until terminated by either you or the Company. You may terminate these Terms of Use at any time, provided that you discontinue any further use of the Website. The Company may terminate these Terms of Use at any time and may do so immediately without notice, and accordingly deny you access to the Website.
10.2 Such termination will be without any liability to the Company. Any such termination of the Terms of Use shall not cancel your obligation to pay for Service(s) already ordered from the Website or affect any liability that may have arisen under the Terms of Use prior to the date of termination.
11.1 If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
12.1 The Company shall not be considered to be in default of performance of its obligations, if such performance is prevented or delayed for any causes beyond the reasonable control of the Party affected including war, hostilities, revolution, riots, civil commotion, strikes, lockouts, epidemic, fire, explosion, flood, earth-quake, act of God or any act of Government or any other cause beyond the control of the concerned Party which could not have been foreseen or avoided by the exercise of due diligence.
13.1 This Agreement shall be governed by and construed in accordance with the laws of India.
13.2 The competent Courts at Hyderabad, India shall have the sole and exclusive jurisdiction to try and entertain all the disputes arising out of or in relation to the User's use of the Website.
14.1 Any Notice by the Company will be sent by email or by general notification on the Website.

15.1 These Terms constitute the entire or sole legal agreement between you and the Company and shall supersede and prevail any prior agreements, whether oral or written, regarding subject matter hereof.
15.2 If any one or more of the provisions of this Terms is or becomes invalid, void, illegal or unenforceable, the validity, existence, legality and enforceability of the remaining provisions will not in any way be affected, prejudiced or impaired.
